BCP Executive Search’s Charter of Personal Data Protection

The consulting and recruitment firm BCP Executive Search is concerned about the protection of the privacy and data of its contacts (users of its website and Internet platform, contacts established within the framework of strategic consulting and recruitment mandates, professional meetings, partnerships or consultancy services, applicants, etc.). Thus, BCP Executive Search ensures that it adopts and complies with a data processing policy that complies with current regulations.

In this respect, the recruitment firm complies with the applicable European law on the protection of personal data, and in particular with European General Regulation on the Protection of Personal Data No. 2016/679 of 27 April 2016 (known as "RGPD / GDPR"), as well as all the rules of national law adopted pursuant to it and which may, in the alternative, apply as appropriate.

The purpose of this Personal Data Protection Charter (the "Charter") is to inform the persons concerned ("you" or "your") in a clear, simple and complete manner about how BCP Executive Search, in its capacity as responsible for processing, collects and uses personal data concerning you ("personal data") and how you can control such use and exercise your rights relating thereto.

 

When is your personal data collected ?

BCP Executive Search may have to collect your personal data in the context of strategic consulting or recruitment mandates, for professional meetings, files, partnerships and applications, during your visit to our office, our websites and web pages and your use of our online services.

Declarative personal data are those that you provide via forms, whether they are dematerialised on websites, in paper format or in response to questions asked by partners or associates of the firm.

BCP Executive Search takes into account the principles of data minimisation, data protection from the design stage and data protection by default. Consequently, relevant, adequate and limited information shall be collected only as necessary for the purposes for which it is processed.

How is the security of your personal data protected ?

BCP Executive Search takes care to protect and secure your personal data in order to ensure their confidentiality and prevent them from being distorted, damaged, destroyed or disclosed to unauthorised third parties.

Where disclosure of data to third parties is necessary and authorised, BCP Executive Search ensures that these third parties guarantee the same level of protection for the data concerned as that offered by BCP Executive Search, and requires contractual guarantees so that, in particular, the data is processed exclusively for the purposes you have previously accepted, with the required confidentiality and security.

BCP Executive Search implements technical and organisational measures to ensure that personal data is kept securely for as long as necessary to fulfil the purposes pursued in accordance with applicable law.

Although BCP Executive Search takes reasonable steps to protect your personal data, no transmission or storage technology is completely fool proof.

In accordance with applicable European regulations, in the event of a proven breach of personal data that may generate a high risk to the rights and freedoms of the data subjects, BCP Executive Search undertakes to communicate this breach to the competent supervisory authority and, where required by the said regulations, to the data subjects (individually or generally as the case may be).

Without prejudice to the above, it is your responsibility to exercise caution to prevent any unauthorised access to your personal data and terminals (computer, smartphone, tablet...).

In addition, the firm's website may provide links to third-party websites that may be of interest to you. BCP Executive Search has no control over the content of these third-party sites or the privacy practices they may have regarding your personal data. Consequently, BCP Executive Search declines any responsibility concerning the processing by these third parties of your personal data, not subject to this Charter. How long is your personal data kept ?

BCP Executive Search keeps your personal data for the time necessary to fulfil the purposes pursued, subject to the legal possibilities of archiving, obligations to keep certain data, and/or anonymisation.

In particular, we apply the following retention periods for these few broad categories of personal data :

  • Personal data of customers/prospects/business partners : as long as the user is active and, at the latest, 3 years after the last contact with the user;
  • Candidates' personal data (recruitment) : time required to process the application and, in the event of a negative outcome, 3 years after the last contact (unless the candidate agrees to a longer period).

Subject to the limits provided for by the regulations in force, you have the right to information on the processing of your personal data, the right of access, rectification, withdrawal and deletion (or "right to forget") of your personal data, the right to limit the processing of your personal data, the right to the portability of your personal data.

Applicable law and competent Court

This Charter is subject to French law. In the event of a dispute and in the event that an amicable agreement cannot be reached, the competent courts shall be those of the Paris Court of Appeal, notwithstanding multiple defendants or warranty claims.
